Terms & Conditions of Purchase

By checking this box at checkout, you (“Client”) agree to the following Terms & Conditions for participation in Creating Forward Incubator CMO Suite (“Program”) delivered by Creating Forward Studio (“Company”).

1. What’s Included:
As part of the Program, you receive access to the following:

- Three Core Training Tracks with deep-dive modules and founder playbooks

Please note: All support elements must be used by the end of the Client’s program. Unused sessions, submissions, or access will expire when the program ends and cannot be rolled over.

2. Program Fee and Payment Terms
The fee for the Program is $7125 as part of the Founding Cohort Launch Pricing if the Client pays in full at the time of enrolment, or three (3) monthly payments of $2,400 if the Client selects the payment plan. This is a limited-time, non-standard rate offered exclusively for founding members.
By enrolling in the Program, the Client agrees to pay the full program fee, either in a single payment or according to the monthly payment schedule. If a payment plan is selected, the Client authorises the Company to charge the provided payment method automatically each month until the balance is paid in full. The Client is responsible for maintaining valid payment details throughout the payment period. Missed or failed payments may result in late fees or temporary removal from the Program. No invoice reminders will be issued for recurring charges.
The Client agrees to reimburse the Company for any pre-approved expenses incurred to support the delivery of the services, as well as for any additional services requested beyond the original scope. Any such additional services or expenses must be agreed upon in writing by both parties before they are incurred.
Late payments will incur a 3% fee for each week past the due date. If a payment is more than fourteen (14) days overdue, the Company reserves the right to pause services until the outstanding balance is resolved.

3. Recurring Billing Authorization
By selecting a payment plan, the Client authorizes Creating Forward Studio to charge the provided payment method automatically on the agreed schedule until the balance is paid in full. The Client is responsible for ensuring that payment details are up to date and sufficient funds are available. Failed payments may result in late fees, paused services, or removal from the program.

4. Refund & Cancellation Policy
All sales are final. Due to the nature of the services and the resources provided, no refunds will be issued for any reason. By purchasing, the Client agrees to complete the full payment schedule, regardless of participation. Cancellations are not accepted once the program has begun, unless otherwise stated in writing by the Company.

5. Program Access Duration
Access to the program materials and community will be available for the agreed duration starting from the program start date. Access does not extend beyond the agreed term unless otherwise stated in writing. Lifetime access is not guaranteed unless explicitly stated.

6. Media Release / Image & Testimonial Use
The Client agrees that their feedback, testimonials, and any photos, audio or video shared during the program may be used by the Company for marketing purposes. The Client may request anonymity, and the Company will honour that request. No confidential materials will be shared publicly without consent.

7. Disclaimer of Results / No Guarantees
The Company makes no guarantees about specific results, income, or business performance. The Client is solely responsible for applying the strategies and tools provided. Any examples of outcomes shared are for illustration purposes only and do not represent promises of future results.

8. Force Majeure
The Company shall not be liable for delays or failure to perform due to causes beyond its control, including but not limited to acts of God, internet outages, strikes, illness, or changes in government regulation. In such cases, services may be paused and resumed when reasonably possible.

9. Indemnification
The Client agrees to indemnify and hold harmless the Company and its team from any claims, liabilities, losses, or expenses (including legal fees) arising from participation in the program, use of the materials, or violation of this agreement.

10. Non-Disparagement
The Client agrees not to make public or private statements that may be harmful to the reputation of the Company or its team, during or after the engagement. The Company agrees to the same standard of professionalism and discretion regarding the Client.

11. Participant Behaviour
The Client agrees to participate respectfully and professionally in group settings. The Company reserves the right to remove any participant from group communications, community spaces, or live sessions without refund if their behaviour is disruptive, harmful, or inappropriate.

12. Delivery of Services
The Services shall be performed only by the Company or any other person who is approved by the Client in writing or verbally.

13. Term of Agreement
The Services will run for 12 weeks following the start date, or as terminated pursuant to this Agreement. Ongoing services and fees with additional support to be agreed upon as needed.

14. Client Feedback and Promotional Use
As part of the founding cohort, you will receive bi-weekly forms to provide feedback on the program. Examples of the Client’s business, collaboration, and testimonials may be used for marketing purposes. The Company agrees to anonymise materials on request.

15. Taxes
Taxes to be paid on fees collected will be the responsibility of the Company.

16. Standard of Services
The Company shall perform services to a professional industry standard. Delays by the Client, including failure to provide requested materials, may affect delivery timelines. The Client agrees to commit adequate time and engagement to support successful outcomes.

This is a done-with-you style programme. The Company will provide guidance, resources, and strategic support, but is not responsible for completing work on behalf of the Client unless explicitly agreed to in writing outside the scope of this programme.

17. Time of Services
The Company is not bound to the Client’s specific time zone. However, reasonable efforts will be made to ensure availability for live sessions, meetings, and support within standard working hours for the majority of participants. All other work and communication may be completed according to the Company’s preferred schedule and time zone.
Clients are responsible for checking session times in their own time zone and ensuring their availability to participate as needed.

18. Conflicts
The Company may provide similar services to other clients unless it creates a direct conflict with the Client’s business interests.

19. Licenses and Permits
The Company shall maintain all applicable licenses and approvals relevant to service delivery and will provide documentation upon request.

20. Compliance
The Company will comply with all applicable laws and any relevant Client regulations made known prior to the engagement.

21. Insurance
The Company will maintain reasonable insurance coverage to protect the Client from liability related to service delivery.

22. Non-Competition
For one (1) month following the end of the Program, the Company agrees not to engage in directly competitive activities that replicate the Client’s exact business model or proprietary approach, using any sensitive information obtained during the engagement. This applies specifically to businesses with a likeness in structure, offer, and positioning — not general category exclusivity.

23. Non-Solicitation
During the term and for 3 months following, neither party will solicit the other’s team or contractors without written consent.

24. Intellectual Property
All IP created specifically for the Client during the Program remains the property of the Client. However, any templates, training materials, or tools provided by the Company are licensed for the Client’s internal business use only and may not be recorded, copied, shared, or redistributed in any form.

25. Confidentiality
All business and personal information shared during this engagement will be kept strictly confidential by both parties.

26. Use of Confidential Information
Company will not disclose, use, or transfer confidential information unless required for service delivery or by law.

27. Third-Party Confidentiality
Company will protect any third-party confidential information disclosed by the Client and ensure its team abides by the same confidentiality terms.

28. No Prior Conflicts
Company affirms it is not under any existing obligations that conflict with this engagement.

29. Independent Contractor Status
The Client understands that participation in this Program does not create a contractor, employee, or agency relationship between the Client and the Company. The Program is educational and mentorship-based, and all guidance provided is for informational purposes. The Client is responsible for implementing the strategies and making decisions for their own business.

30. No Contract Authority
The Company cannot enter into contracts or make decisions on behalf of the Client without written authorization.

31. Termination for Breach
Either party may terminate this Agreement for cause if the other party fails to remedy a breach within 30 business days of written notice.

32. Termination with Notice
Either party may terminate this Agreement with thirty (30) days’ written notice in the event of a material breach, failure to meet payment obligations, change in circumstances, or if the relationship is no longer serving its intended purpose. All outstanding fees must be paid, and any agreed-upon services must be completed or delivered by the termination date for the Agreement to be considered fully resolved. The Client will retain access to the Program during the notice period. No partial refunds will be issued for unused time within this period.

33. Assignment
This Agreement may not be transferred without mutual written consent.

34. Amendments
All changes to this Agreement must be in writing and agreed upon by both parties.

35. Severability
If any part of this Agreement is deemed unenforceable, the remaining sections remain valid.

36. Governing Law and Jurisdiction
This Agreement is governed by California law and any disputes shall be resolved in the courts of Los Angeles.

37. Entire Agreement
This Agreement supersedes any prior communications and constitutes the full agreement between the parties.

38. Notices
Notices may be sent by email or personal delivery and are deemed received upon delivery or 3 days after being sent.

39. Scheduling and Communication Expectations
- 72 hours’ notice is required to reschedule 1:1 sessions.
- Missed sessions result in 50% forfeiture, with the remaining time carried forward.
- The Company will provide reasonable availability during the program term.
- Responses to email and written or voice note communication within the Forward Founder Studio platform will be made during the dedicated Office Hours.
- For the CMO Suite level, direct 1:1 support messages will receive responses within 48 hours (Monday–Friday).
- The Client is expected to arrive prepared and complete tasks to support program progress.
